Experience Matters. The Details Matter.

Helping You Move Forward From Divorce

Ending a marriage creates a lot of questions and anxieties. Where will you live? How will divorce affect your standard of living? How will this affect your children and your relationship with them?

I am Joe Walterman, a family attorney in Greenwood with nearly 20 years of experience. I can guide you through this tough time, protecting what’s most important to you and helping you shape that post-divorce future.

What You Need To Know About Indiana Divorce

Indiana is a no-fault state. This means either party can file for divorce without proving any wrongdoing such as cruelty, adultery or abandonment. Indiana is also an equitable distribution state. This means the wealth you accumulated during marriage must be divided in a fair (but not necessarily equal) manner, regardless of who was the breadwinner or whose name is on the title.

I will help you value your joint assets. From there we work through the give-and-take to reach a resolution. A divorce settlement may encompass:

  • The marital residence and home equity
  • Retirement savings and investments
  • Cars, furniture and valuables
  • Loans, credit cards and debts
  • Ownership stake in a business
  • Continuation of health insurance
  • Temporary spousal support or long-term maintenance (also known as alimony)
  • Child custody, parenting time and child support

Divorce litigation can be financially and emotionally draining, especially when children are involved. I encourage negotiation to control the costs and the outcome, but sometimes it is necessary to go to court and I have the courtroom experience necessary to resolve the case.

Alternatives To Contested Divorce

Sometimes couples are living apart but are not ready to dissolve the marriage because of religious reasons, practical reasons or a hope of reconciling. I can help you craft a formal legal separation to address possessions, bank accounts, parenting arrangements and financial support.

If you have made the mutual decision to divorce and mostly agree on property, custody and other issues, I can help you button down the specifics of an uncontested divorce and present it to the court.
